While refusing to grant a direction to the Special Investigation Team
which is probing into the Seshachalam encounter case within a prescribed
time frame, the Hyderabad High Court ordered the director of Forensic
Science Laboratory to place the report of the ballistic expert
pertaining to the weapons used in the encounter by police officials as
early as possible.
A division bench comprising Acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt was dealing with the petitions by Chilaka Sudhakar, general secretary of the civil liberties committee and Muniammal wife Sashi Kumar seeking to book case under Section 302 of IPC (Murder) against the police personnel involved in the encounter in which 20 alleged red sander smugglers were killed on April 7, 2015 at Seshachalam hill ranges in Chittoor district.
Ms Vrinda Grower, counsel appearing for the families of the victims and V. Raghunath, counsel for Civil Liberties told the bench that the SIT has failed to complete the probe within 60 days despite of a direction from this Court. Counsel for the AP government submitted that in view of the allegations by the petitioners suspecting the role of the state government in the encounter, it was not possible for the SIT to probe into all the angles.
Ms Vrinda Grower said that the SIT has not taken any steps to identify the police officers involved in the encounter. She urged the court to appoint an independent prosecutor to prosecute the case. Counsel for the government said they have already explained all the steps in the status report that was placed before it including the statements of three witnesses which are claimed to be crucial in the case by the petitioner. After perusing the status report, the bench asked the investigation officer to take an independent decision in conducting an “identification parade” to identify the cops and adjourned the matter to September 7.
SP to probe sand mafia problem:
A division bench comprising Acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt of the Hyderabad High Court on Monday directed the SP of Mahbubnagar district to order a probe by a senior police officer to find out the culprits behind the sand mafia that was attacking farmers and government servants and file a report within a week.
The bench was dealing with a plea by Watch-Voice of the People, an NGO seeking to declare the inaction of authorities against illegal sand mining in Mahbubnagar district as illegal.
A. Sanjeev Kumar, special counsel appearing for the state submitted that they had registered FIRs, arrested some people and even suspended some cops like SIs and constables. He also furnished the status of the cases. After examining the status of the case, the bench found fault with the SP’s attitude, who despite being head of the district police, exposed his subordinates and left out culprits.
The bench said, “It seems that most officials are hand-in-glow with sand contractors and that is the reason they are indulging in illegal mining.” When the bench asked counsel for the petitioner P. Shashi Kiran whether he would be able to furnish names of persons responsible for illegal mining, he replied in the affirmative and said that many victims are ready to depose before the court or authorities. The bench directed the SP to depute a senior police officer as investigation officer to record the statements of victims and the petitioner and provide protection to witnesses.

The Hyderabad High Court on Monday disposed a PIL challenging sale of liquor in PET bottles, by permitting the petitioner to approach the National Green Tribunal. The HC was dealing with a plea by Vaayu Vision Educational Society of Vijayawada.
