Shankar Narayana reserved orders on batch of petitions challenging the
action of the Telangana state government in deleting 26 castes from the
list of Backward Classes.
The state government had issued the notification deleting 26 castes including Kalinga, Toorpu Kapu, Gavara, and Setti Balija, Koppulavelama and other castes from the list of BCs. The government said some of the BC groups which reside exclusively in Andhra Pradesh and are not found in Telangana would not reservation under the BC category.
The petitioners claimed that the Telangana government had taken the decision unilaterally without recommendation from the BC Commission. They said there was no BC Commission in the state since 2011. The government’s decision was costing them jobs in MBBS and engineering.
Land conversion act upheld:
A division bench comprising acting Chief Justice Dilip B. Bhosale and Justice S.V. Bhatt upheld the provisions and application of the AP Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006, which prohibits conversion of agricultural lands into non-agricultural purposes, except with specific permission by the authority under the Act.
While dismissing a batch of writ appeals filed by several real estate developers, the bench made it clear that when layouts are sought to be prepared on agricultural land, specific permission by the competent authority must be submitted after payment of fee.
HC sets aside Lokayukta order: A full bench comprising acting CJ Dilip B. Bhosale, Justice Vilas Afzulpurkar and Justice S.V. Bhatt ruled that the Lokayukta does not have jurisdiction to entertain and adjudicate on matrimonial matters. The bench was dealing with a writ petition by a doctor challenging the decision of the Lokayukta in entertaining a petition against him by his wife.
DCP told to consider plea: Justice A.V. Sesha Sai directed the Hyderabad South Zone DCP to consider the application of Ahle Hadees, a Muslim religious organiation, seeking permission to hold a meeting in the old city by 2 pm on Saturday.
While disposing of a petition by challenging the DCP’s decision to deny permission for the meeting, the judge passed oral orders directing the petitioners to submit a fresh application along with the names of the speakers.
High Court rejects colleges’ plea against bank guarantee G.O.:
The Hyderabad High Court on Friday refused to take up as a lunch motion, a plea filed by managements of private non-minority medical and dental institutions in Telangana challenging a GO with regard to seeking bank guarantee from students admitted under the management quota.
On August 26, the government had issued the GO directing the managements to seek bank guarantee for tuition fee for every year instead of for the entire course at the time of admission into the first year MBBS or BDS.
The managements had sought permission from a division bench comprising Justice R. Subhash Reddy and Justice A. Shankar Narayana to take up their plea as lunch motion.
The bench also granted a week’s time to students, who had approached the court, to furnish bank guarantee for one year.
